RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT

Light Fighter Support Operations Course

READ THIS CAREFULLY. BY SIGNING IT YOU GIVE UP LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE FOR INJURY CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES.

1. The parties

"LFM" means Light Fighter Manifesto L.L.C., a Georgia limited liability company.

"Released Parties" means LFM and its member, managers, employees, instructors, staff (including any EMT-qualified staff), volunteers and agents, and the owners and occupiers of any property the course uses.

"I" and "me" mean the student signing this agreement.

2. The course

This agreement covers my participation in the Light Fighter Support Operations Course ("the course"): a two-day, in-person field course held in Central Georgia on the dates of the session I registered for, or on any later date my seat moves to. It covers every part of the course, including: instruction; hands-on equipment work; planning; reconnaissance; sourcing trips to third-party businesses; travel between course sites; the field exercise; site setup and teardown; and the after-action review.

3. Who may take the course

I confirm that:

  • I am at least 18 years old. I will show photo ID at check-in.
  • I hold a valid driver's license, and I will drive my own vehicle with current insurance as the law requires.
  • I am physically able to take part. That includes lifting and carrying about 40 pounds, moving on foot over uneven ground, and working outdoors for long days in any weather.
  • I have told LFM in writing about any medical condition, medication, allergy or injury that could affect my safety or anyone else's during the course.

4. The risks of this course

I understand the course is physical, outdoors, in a group, and runs rain or shine. Its risks include the following:

  • Vehicle travel. I drive my own vehicle between course sites, including in the early morning and in the dark. Collisions, breakdowns and road hazards can happen.
  • Lifting and carrying. Litter carries and moving equipment and batteries can cause strains, sprains, back injury, falls and crush injuries.
  • Lithium batteries and electrical work. Salvaging, testing and wiring battery cells can cause fire, explosion, burns, electric shock and exposure to harmful chemicals and fumes.
  • Tools, salvage and fabrication. Hand and power tools, sharp and broken metal, and salvaged parts can cause cuts, punctures, eye injury and burns.
  • Third-party premises. Salvage yards, pawn shops and other businesses are not controlled by LFM, and have hazards of their own.
  • Drones. A drone supply drop and recovery can involve falling objects, moving propellers and parts.
  • Alarms, cameras and site work. Tripwires, cables and equipment create trip and fall hazards.
  • Bleeding control training. Practising with tourniquets and other bleeding-control equipment, on myself or on others, causes pain and can cause bruising, numbness and, rarely, nerve or tissue injury. The casualty scenario involves carrying and moving a simulated patient.
  • Terrain and weather. Uneven ground, water, vegetation, darkness, heat, cold, rain, lightning, insects, snakes and poisonous plants.
  • Other people. The acts or mistakes of other students, staff, and members of the public.
  • Distance from care. Course sites may be far from a hospital. Emergency help may be delayed.

These risks can cause injury, illness, permanent disability, death, and damage to or loss of property, including my vehicle and equipment. This list is not complete. Other risks, known and unknown, may arise.

5. ASSUMPTION OF RISK

I CHOOSE TO TAKE PART IN THE COURSE VOLUNTARILY. I KNOW AND UNDERSTAND THE RISKS DESCRIBED ABOVE, AND I ASSUME FULL RESPONSIBILITY FOR ALL OF THEM, INCLUDING THE RISK OF BODILY INJURY, DEATH AND PROPERTY DAMAGE CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES.

6. RELEASE AND WAIVER OF CLAIMS

IN RETURN FOR BEING ALLOWED TO TAKE PART IN THE COURSE, I RELEASE, WAIVE AND FOREVER DISCHARGE THE RELEASED PARTIES FROM ALL LIABILITY, AND ALL CLAIMS, DEMANDS AND CAUSES OF ACTION, FOR ANY INJURY, ILLNESS, DEATH, OR DAMAGE TO OR LOSS OF PROPERTY ARISING FROM MY PARTICIPATION IN THE COURSE, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE.

This release does not cover gross negligence, or wilful or wanton misconduct, by a Released Party.

7. PROMISE NOT TO SUE, AND INDEMNITY

I PROMISE NOT TO SUE THE RELEASED PARTIES FOR ANY CLAIM THIS AGREEMENT RELEASES.

I WILL INDEMNIFY AND HOLD HARMLESS THE RELEASED PARTIES AGAINST ANY CLAIM, LOSS OR COST, INCLUDING REASONABLE ATTORNEY'S FEES, THAT ARISES FROM MY OWN ACTS OR OMISSIONS DURING THE COURSE, INCLUDING INJURY TO OTHER PEOPLE OR DAMAGE TO THEIR PROPERTY.

8. My vehicle and my equipment

I drive my own vehicle at my own risk and under my own insurance. I obey all traffic laws. LFM does not supply, inspect or insure my vehicle. I am responsible for my own personal equipment. LFM is not responsible for its loss or damage, except as section 6 allows.

9. Rules and removal

I will follow the safety briefings and instructions of LFM staff. I will not take part while impaired by alcohol or drugs. LFM may remove me from the course, without refund, if I refuse a safety instruction or put myself or anyone else at risk.

10. Who this agreement binds

This agreement binds me, my spouse, my heirs, my executors, my personal representatives, my assigns, and anyone claiming by or through me.

11. Breadth and severability

This agreement is intended to be as broad and inclusive as the law of the State of Georgia permits. If any part of it is held invalid, the rest continues in full legal effect.

12. Governing law and venue

The law of the State of Georgia governs this agreement. Any claim must be brought in the courts of Upson County, Georgia.

13. Entire agreement

This agreement, together with the course terms at lightfightermanifesto.org/terms/, is the entire agreement about my participation. No one has made me any promise that is not written here.

I HAVE READ THIS AGREEMENT. I UNDERSTAND IT. I AM GIVING UP SUBSTANTIAL RIGHTS, INCLUDING MY RIGHT TO SUE FOR NEGLIGENCE. I SIGN IT VOLUNTARILY.

You accept this release online before you pay for a seat. At check-in you also sign it on paper, together with an emergency medical authorization and an optional photo consent.
